Abstract

An Act to provide for the control of the manufacture, importation, sale, storage and use of pesticides, and for matters connected therewith or incidental thereto. The Act makes provision for the establishment of the Pesticides Control Board and for its functions, and for the licensing of manufacture or import of pesticides and the registration of pesticides in the Register of Pesticides. No definition of pesticides is given but a list of registered pesticides and a list of restricted pesticides can be found in Schedule II respectively Schedule III. These lists may be amended from time to time by the Minister, by Order, in consultation with the Board (subsects. 6[2] and 8[2]). Manufacture, import or sale of pesticides require a licence to be obtained from the Board (subsect. 6[3]). No person shall sell a restricted pesticide unless: (a) he is authorized in the prescribed manner to do so; (b) the premises in which the sale is carried out has been registered in the precribed manner for the purpose; and (c) the sale is carried out in accordance with such other requirements as may be prescribed (subsect. 8[1]). For the registration of licences, authorized persons, authorized applicators, and pesticides separate registers shall be kept (sect. 11). Pesticides not registered as required in section 6 or listed under section 8 shall be prohibited pesticides and accordingly shall not be brought into or used in Belize (sect. 13). Schedule IV contains a list of prohibited pesticides. Section 17 deals with powers of inspectors appointed by the Minister under section 16. Section 18 provides for certificates of inspection.
