The decree establishes the conditions for the approval of the pesticides and for the recognition of authorities and organisms entitled to carry out tests and analyses. Further provisions concern the issue, renewal, re-examination, withdrawal and updating of the authorization. The Decree regulates also the placing on the market and control of active substances to be used in compliance with the provisions of article 2, paragraph 1, letter a. Furthermore, it provides for the placing on the market of products containing genetically modified organisms according to Legislative Decree of 3 March 1993, No. 92. Articles 15 and 16 concern the packaging and labelling of phytosanitary products. The Decree states the free access to the information provided in the application for the authorization. Nonetheless, upon request of the applicant and subsequent approval of the Ministry of Health, the information regarding industrial or commercial processes may be deemed confidential. Said rule cannot apply: (a) to the name and content of the product or active substance; (b) to the physical and chemical data; (c) to the precautions and modalities recommended in order to limit any risk during processing, storage and transport; (d) to the decontamination and first aid measures in case of accidental loss or emission.
