Abstract

The present Law implements the Federal Waterworks Act of 21 June 1991. In particular, the Law lays down provisions relating to waterworks, maintenance of waters, the water police, as well as to the enforcement of federal legislation. The Law shall apply to all public surface waters. Furthermore, the Law shall ensure the protection of human beings and appurtenances of value against the damage resulting from water, to conserve the waters in a natural way or to arrange them in a natural way and to use them sensibly. Moreover, the present Law allocates the related powers concerning waterworks between the Canton, the municipalities and private parties. The text consists of 38 articles divided into 7 Parts as follows: General provisions (I); Maintenance of waters (II); Land use planning measures (III); Waterworks (IV); Financing (V); Omissis (VI); Final provisions (VII).
