Abstract

The Regional Act, which is divided into eight Titles, pursues the conservation and restoration of wildlife in order to contribute to the ecological balance and the safeguarding of agricultural production. To this end, the Region shall elaborate the programme concerning the use of its territory, in accordance with Act No. 157 of 11 February 1992. The Regional Authority shall approve, on the one hand, the Plan on wildlife and hunting (art. 3) and shall co-ordinate, on the other hand, the provincial plans referred to in article 4. Furthermore, the Region shall promote studies, research and interventions relating to wildlife and environmental protection and shall carry out controls. Further functions are entrusted to the Region and to the Provinces by article 2. The following institutions are established by articles 8 and 9 respectively: the Regional Council for Wildlife and Hunting and the Observatory for Natural Habitats and Wildlife Population. Title II of the Act regards the programmed management of the regional territory, which shall be divided into territorial hunting areas (ATC), to be managed by the organisms referred to in article 11. Title III specifies the different areas to be created: protection oasis (art. 15), repopulation and capture zones (art. 16), public and private centres for wildlife reproduction (art. 17). Title IV lays down detailed rules in matter of hunting authorization. Hunting is prohibited on cultivated lands (art. 21). Further provisions hereby contained concern game farming (art. 23) and taxidermy (art. 27). Title IV regulates hunting. In particular, the Regional Council must draw up the hunting calendar, upon advice given by the National Institute for Wildlife (art. 32). Title VI makes provision in matter of inspection and controls to be carried out. Title VII sets out the penalties to be applied in case of violation of these provisions.
