Abstract

These Regulations impose a regulated control scheme in respect of the commercial growing, harvesting, sorting, and transporting of bivalve molluscan shellfish (BMS). Regulations 9-18 deal with standards related to the following: vessels, vehicles, and buildings responsible for the harvest, transport, sorting, or storage of BMS; packing, packaging, and storage; relaying, wet storage, and depuration; identification, labelling, and record keeping. Obligations and duties of growers, harvest operators, relay operators are outlined in regulations 19-24. Limits on harvesting and laboratory requirements are set out in regulations 25-28. The Director-General or an animal product officer may classify growing areas for the growing of BMS, based on the quality of water and BMS (regs. 29-33). Harvest operators shall apply to the Director-General for registration as provided for in regulations 34-44. Relay operators may apply for a permit to an animal product officer (regs. 45-47). The Director-General must keep and maintain a list of growing areas, transport operators, sorting shed operators, and BMS depot operators for industry members and public knowledge (regs. 48-55). Part 4 contains penal and transitional provisions.
