Vending means selling goods by retail to passersby in a public place and includes offering or exposing goods for such sale. The sale of fish by a fisherman registered under regulation 12 of the Fisheries Regulations 2010, the sale of food and drink by a person temporarily licensed to operate a food stall that is a victualling establishment under regulation 5 of the Public Health (Food) Regulations 1950 and the sale of Bermuda-made products shall not be considered vending for the purposes of this Act. Any person who vends without a licence commits an offence. Licences may be obtained at specified conditions from the Executive Director of the Bermuda Economic Development Corporation. A minor amendment is made to regulation 5 of the Public Health (Food) Regulations 1950.
