Résumé This Law regulates the modalities of creation and protection of fish stock, stock enhancement, fish farming and catch of aquatic resources and amelioration of fishing waterbodies, and also establishes the competence of the authorized state fisheries institutions. Fishing right in natural waterbodies shall be granted to natural persons and legal entities on the basis of a certificate of granting quota/quotas for commercial fishing, permit for commercial fishing, permit for sport, artisanal and recreational fishing, permits for fishing for scientific research and control purpose, issued by issuing authority. The cost of the certificate of granting quota/quotas for commercial fishing is made up of the cost of the quota or the sum of quota values proposed by the auction winner. The amount set for the certificate of quota/quotas for commercial fishing is transferred to the National Environmental Fund. Permit for sport, artisanal and recreational fishing shall be issued by issuing authority to natural persons on application, upon presentation of proof of payment of fees. To the application, a copy of the applicant's identity card is attached. Fishing of rare and endangered aquatic biological resources inserted in the Red Book of protected and endangered species shall be prohibited. Live aquatic organisms recorded in the Red Book shall be subject to mandatory registration by the authorized institutions. Trade and transport of live fish shall be authorized only in the presence of veterinary certificate and documents evidencing the origin of commodities. This Law establishes prohibited fishing areas throughout the year. The Act consists of ten Sections divided into 44 articles: (1) general provisions; (2) competence of governmental bodies; (3) fishing authorization and fishing permit; (4) fisheries; (5) reproduction and acclimatization; (6) fish farming; (7) fishing inspection; (8) protection of aquatic biodiversity in the natural fishing waterbodies; (9) liability; and (10) conclusive and transitional provisions. The basic principles of aquatic biodiversity management shall be: (a) conservation of aquatic biodiversity; (b) long-term utilization of aquatic biodiversity; (c) stock enhancement and repopulation; (d) development of fisheries; (e) water and fishing resources monitoring; (f) development of fish farming; and (g) transparency and openness of the issuance of fishing authorization. Fishing permit for industrial, commercial, sport and artisanal fishing shall be issued annually by Fishing Inspection. Sport and artisanal fishing shall be authorized with the following fishing gear: (a) fishing rods of all types; (b) spinning rods; (c) gear for the catch of crayfish; and (d) landing-nets. The number of fish-hooks must not exceed five per person. Annual quotas shall be set for each waterbody. Artificial repopulation of fish stocks shall be carried out by the owners of artificial fishing waterbodies. The right of use of the plots of land and waterbodies for fish farming shall be granted exclusively to the owners of waterworks located in a given waterbody that shall be held responsible for maintenance and repairs of the aforesaid waterworks. Fish farmers shall be united in fish farming association. The Act establishes also prohibited fishing seasons and prohibited fishing areas for all the national inland waterbodies.
