Résumé

This Technical Regulation implements Regulation (EU) No. 1308/2013 of the European Parliament and of the Council establishing a common organization of the markets in agricultural products and repealing Council Regulations (EEC) No. 922/72, (EEC) No. 234/79, (EC) No. 1037/2001 and (EC) No. 1234/2007, Commission Regulation (EC) No. 606/2009 laying down certain detailed rules for implementing Council Regulation (EC) No. 479/2008 as regards the categories of grapevine products, oenological practices and the applicable restrictions, Commission Regulation (EC) No. 607/2009 laying down certain detailed rules for the implementation of Council Regulation (EC) No. 479/2008 as regards protected designations of origin and geographical indications, traditional terms, labelling and presentation of certain wine sector products, Commission Regulation (EC) No. 436/2009 laying down detailed rules for the application of Council Regulation (EC) No. 479/2008 as regards the vineyard register, compulsory declarations and the gathering of information to monitor the wine market, the documents accompanying consignments of wine products and the wine sector registers to be kept and Commission Regulation (EC) No. 1254/2008 amending Regulation (EC) No. 889/2008 laying down detailed rules for implementation of Council Regulation (EC) No. 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and control. This Technical Regulation establishes the basic rules for the organization of the grape and wine market, the production capacity rate, specific requirements for the production of wine and wine-based products, the stages of organizing the production and trade of grape and wine products with a protected appellation of origin (DOP) and with a protected geographical indication (IGP), the procedure for the development and approval of technical specifications, specific standards for the production of ecological wine production, allowed technological processes and restrictions in winemaking, requirements for labelling and traceability of grape and wine products, as well as procedures for assessing the conformity of grape and wine products. The production potential is an area planted with grape varieties listed in the Catalog of Plant Varieties of the Republic of Moldova, which is defined as a "grape farm". The creation of vine plantations shall be performed within a delimited grape and wine area. In the production of wines, products derived from mash and products derived from wine specified in paragraph 34 of this Technical Regulation, shall be used freshly hand-picked or machine-cleaned grapes of varieties such as Vitis vinifera, Vitis labrusca or crosses of the species Vitis vinifera and other species of the genus Vitis (varieties of new breeding). It is forbidden to use caps or foil containing lead when packing wine and wine products. Organoleptic parameters of wines should correspond to this category, variety or assortment of used grape varieties and place of origin (for wines with DOP or IGP) and be: (a) healthy, without foreign taste and smell; (b) transparent, without sediment and foreign inclusions. The new wine, which is still in the process of fermentation, can have a slight opalescence, and the wine aged in bottles, according to letter e) of item 149 of this Technical Regulation, may have a natural sediment on the walls and bottom of the bottle. By the color of the wine shall be classified as white, pink and red. A batch of grape and wine products may be placed on the market with the indication on the label or consumer packaging of the designation "denumire de origine protejată" (DOP) or "indicaţie geografică protejată" (IGP), subject to compliance with the established requirements for such denomination. Each batch of “DOP” and “IGP” grape and wine products must pass state certification. This Technical Regulation classifies ecological grape and wine production and establishes authorized technological production methods and use restrictions.
