Résumé

This Regulation of the Environment Protection and Energy Department, made under provisions of Chapter 14 the Swedish Environmental Code, provides rules for the makes provision for the approval and management of pesticides, which may be in the form of plant protection products or biocidal products. The Regulation completes rules as laid down by the Environmental Code and the main EU Regulations in the field of plant protection products management, i.e. Regulation (EU) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market and Regulation (EU) No 528/2012 of the European Parliament and of the Council concerning the making available on the market and use of biocidal products. Unless otherwise specified in this Regulation, terms in the Regulation have the same meaning as in the EU Regulations. Rules on control and supervision for purposes of this Regulation and the EU Regulations can be found in Chapter 26 of the Environmental Code and in the Environmental Control Regulation (SFS 2011:13). The Swedish Chemicals Agency shall be the main supervisory and regulatory body for purposes of Regulation (EC) No 1107/2009. It examines the issues of authorization, approval, dispensation and other measures already examined in other Member States in accordance with Regulation (EC) No 1107/2009. Before the Swedish Chemicals Agency determines such an issue, it must hear, if clearly required, the Swedish National Agricultural Agency and the Swedish Food Agency and the Swedish Forest Agency, if forest land is affected. the Regulation concerns, among other things, protection of water resources from pesticides.
