These Regulations apply to: (a) the activities referred to in section 20(3) of the Water Environment and Water Services (Scotland) Act 2003; (b) the direct or indirect discharge, and any activity likely to cause a direct or indirect discharge, into groundwater of the substances listed in Schedule 2; and (c) any other activity which directly or indirectly has or is likely to have a significant adverse impact on the water environment. The Regulations also place a duty on the Scottish Environment Protection Agency to monitor compliance with and enforce the provisions of the Regulations.
