The first Part covers the scope of the Regulations, which is the implementation of the EU legislation on waste, the objective of which is to protect the environment and human health by preventing or reducing the adverse impacts of the generation and management of waste and by reducing overall impacts of resource use and improving the efficiency of such use. This Part also cope with exclusions and definitions, including by-products and end-of-waste status, and it provides for a list of waste, binding as regards determination of the waste which is to be considered as hazardous waste. The second part approaches the extended producer responsibility giving space to the evaluation, by the competent authority, of the technical feasibility, economic viability and overall impact when applying it. It also introduces the prohibition of mixing separately collected waste and the obligation of setting up separate collection. Part three is dedicated to the waste management, which rests on the original waste producer or other waste holder who carries out the treatment of waste. This part also foresees provisions concerning the management of hazardous waste with a view of protecting the environment and human health (including the ban of their mixing) and provisions concerning Waste oils. Part four requires that any establishment or undertaking intending to carry out waste treatment shall obtain a permit issued upon the accomplishment of some conditions, including the possession, by the personnel involved, of minimum qualifications and the observation of after-care obligations. Establishment or undertakings and activities laid down in Schedule 4 shall be exempt from the permit requirement but the Competent Authority will keep a register of them. Part five encompasses the provision of waste management plans attaining the objectives set out by Schedule 4 and respecting the strategy for the reduction of biodegradable waste going to landfill (referred to in the the Waste Management (Landfill) Regulations, 2002; it also provides for waste prevention programmes. Part six regulates the periodic inspections to which waste operators are subject as well as the records that they must make available for the competent authority regarding the quantity, nature and origin of the waste, the destination, frequency of collection, mode of transport and treatment method foreseen in respect of the waste. This part also foresee offences and relevant penalties, includingthe application of articles of the criminal code. The last part sets out final provisions, among which is the revocation of the Waste Management (Permit and Control)Regulations, 2001 and the Waste Management (Waste Oils) Regulations, 2002. The ten following schedules concern the disposal operations (sch.1); the recovery operations (sch.2); the properties of waste which render it hazardous (sch.3); the exclusion from the requirement of the issuance of a permit conditioned to the rehabilitation, monitoring and remedial action to be carried out after the cessation of a waste management (reg.24(1)); waste prevention programmes and waste management plans (sch.5); examples of waste prevention measures referred to in regulation 36 (sch.6); the extended producer responsibility (sch.7); the last three schedules provide for examples of forms: the consignment permit application form(sch.8); the consignment note (sch.9) and the end of waste criteria declaration (sch.10).
