Should there be a conflict between this Act and any other, this Act shall apply. Part 2 deals with Prohibitions and Permits. Under this Part, section 3 deals with the strict liability with regards to the disposal of waste. Section 8 deals with special waste storage and disposal, and section 9 refers to the transportation of special wastes. Littering is made a strict liability offence, together with discharge of waste from recreational vehicles (sect. 9). Section 12 deals with spill prevention and reporting, and all other sections under this Part deal with permits to introduce waste into the environment, to store special waste or to treat or recycle it. Part 3 details Municipal Waste Management. Under this Part, section 18(1) provides for a municipality to submit, for approval, by the Minister, a waste management plan respecting the management of municipal liquid waste. Section 19 outlines the authority to manage municipal solid waste and recyclable material in regional districts. Municipal solid waste disposal fees are discussed in section 19(1), whilst power is given to the Lieutenant Governor in Council to designate all or a specified part of a municipality as a sewage control area (sect. 22). Specific controls of air contaminants and the solid waste in Greater Vancouver, are outlined in section 24. Part 4 deals with Contaminated Site Remediation. "Remediation" means action to eliminate, limit, correct, counteract, mitigate or remove any contaminant or the negative effects on the environment or human health of any contaminant. This part outlines identification procedures of Contaminated Sites, and at section 27 it deals with general principles of liability for remediation. Implementation of Remediation is outlined in great detail. Delegation of responsibilities to municipalities or other ministries, and Ministry Authority, are to be found in divisions 5 and 6. Part 5 explores various orders available to enforce this Act. Part 6, sections 38 to 41, contain the clean air provisions, such as control of air contaminants, and fuel emission regulations. Part 7 deals with the appeals procedure, and Part 8 covers miscellaneous matters, including; confidentiality, Waste Management Trust Fund, and offences and penalties.
