Section 1 deals with definitions. Section 2 outlines exemptions, in that a person who carries out a class of operation, activity, industry or work referred to in section 3, and meets the conditions and circumstances set out therein, is exempt from the requirement to hold a permit or approval under the Waste Management Act. For example in section 3 (d) (vii) the operator is required to prepare a contingency plan which documents procedures to be followed during a major fish kill, including the method of disposal of moralities, and obtains the manager's approval to the plan.
