Abstract The purposes of division of land by strata scheme are to share the common property by the owners, allow for the strata lots to be owned and sold or dealt with separately, ensure administration of common property by the owners, and prevent the sale of common property seperately. This Act underlines that a primary strata lot may be further divided under the Land and Titles Act by registration of a strata scheme, unless the strata lot is subject to lease. In addition to that, secondary strata lot cannot be further divided. Strata parcel may be allocated as a development lot with a strata scheme development contract. The period of a strata title created by registration of a strata scheme is 75 years and it may be renewed for further 75 years. This Act sets forth provisions on the application for division and required strata scheme documents; valuation of strata scheme lot; strata scheme development contracts; registration and amendment of strata scheme; establishment, duties and powers of strata scheme corporation; strata scheme by-laws and penalties; regulation of sales of lots; and dispute settlement. This Act amends the Land and Titles Act by adding New Section 2A regarding the unimproved value of estate, including fruit trees, bushes, shrubs, and cultivation of other plants for commercial and other purposes, and the assessment of unimproved value of parcels for non-commercial agricultural and horticultural purposes. Moreover, this Act amends Section 88 regarding land registration for each strata title, Section 100 regarding the conversion of estates held by foreigners, Section 140 regarding divisions and combination of estates. This Act adds new Section 132A regarding the strata title subject to rent, and Part XXVA regarding the valuation of estates in land. Furthermore, this Act amends the Land and Titles (General) Regulations on fees for valuation. This Act also amends the Planning and Development Act related to division of land including registration of strata scheme; and application procedures for land division and combination to Land Commissioner.
