The Lieutenant Governor in Council (LGC) is responsible for declaring such areas if the conditions and requirements are met by the petition (sects. 3 and 4). Landowners may state the variety (ies) of seeds proposed to be produced in that area as well as the geographical boundary of such an area. Each area shall have a Seed Control Committee whose duty is to control, facilitate and protect the growing of seed in the Seed Potato Control Area (sect. 7). Owners or occupiers of land situated within a Seed Potato Control Area must not grow or permit to grow on the land any seed of a variety other than that prescribed under this Act (sect. 8). The remaining provisions deal with offences and penalties and the power to make regulations.
