The Regulations adopt provisions of Council Regulation (EC) No. 1415/2004, in so far as they relate to scallop, within the exclusive fishery limits of the State. The Minister may restrict, through an individual allocation to an Irish sea-fishing boat, the number of fishing days that such boat may fish for scallops in the specified area, or any part thereof, for such period as the Minister may decide. The calculation and allocation of fishing days shall be done in accordance with specified criteria. The transfer of fishing days between Irish sea-fishing boats is prohibited. The Regulations provide for the prosecution of offences.
