Abstract

This Order prohibits, fishing by Welsh fishing boats, Crown Dependency Boats and foreign boats within the Welsh zone unless such boats are licensed by the Welsh ministers. “The Welsh zone” has the same meaning as in the Government of Wales Act 2006. "Crown Dependency Boats" are fishing boats registered under the law of Jersey, Guernsey or the Isle of Man that are not British-owned. "Foreign fishing boats" is defined in the Sea Fish (Conservation) Act 1967. It is a fishing boat that— (a) is not registered in the United Kingdom under Part 2 of the Merchant Shipping Act 1995; (b) is not registered under the law of Jersey, Guernsey or the Isle of Man; and (c) is not British-owned. Certain exceptions on the requirement of a licences are granted for British and Crow-dependency boats (small-scale fishing, fishing for salmon and trout, etc.).
