Abstract

These Regulations make provision in respect of applications for scheduled monument consent, applications for variation or discharge of conditions attached to scheduled monument consent and applications for subsequent approval required by a condition. The Regulations also: provide for certificates which must accompany certain applications; prescribe the forms of notices; and define “owner of the monument”. This definition includes agricultural tenants within the meaning of the Small Landholders (Scotland) Act 1911, the Agricultural Holdings (Scotland) Act 1991 or the Agricultural Holdings (Scotland) Act 2003.
