It provides a series of application forms for plant breeder’s rights, plant variety denomination, incidental fees, and attendant administrative procedures. The Regulation further allows application for plant breeder’s rights to be made by an agent on behalf of another person, provided it is made in the relevant form set out for it. The Registrar, shall inform the applicant where the Register rejects or accepts an application, and also issue a notice to the applicant where it varies the application. For successful applications; the Registrar is to issue a certificate of description of plant variety which verifies the particulars of the plant variety, and the Institute shall grant plant breeder’s rights in respect of a plant variety. The Regulation also provides for the application of licenses, including the license for plant breeder’s rights, compulsory licenses, and incidental issues.
