Abstract

This Order sets forth the procedure for concluding contract for the use free of charge of a fish-breeding site without bidding (tender, auction) with non-commercial fish farms performing aquaculture (fishfarming) related to the conservation of aquatic biological resources. The aforesaid contract shall be concluded between non-commercial fishfarming enterprise and the Federal Fishery Agency in accordance with the application form filed by fishfarming enterprise. On the day of application, the applicant must comply following requirements: (a) there are no bankruptcy proceedings against the applicant and liquidation of the enterprise; (b) the activities of the applicant are not suspended in accordance with the procedure envisaged by the Code of the Russian Federation on Administrative offences; (c) the applicant does not have an unfulfilled obligations related to payment of taxes, dues and other mandatory payments; (d) there is no effective court decision against the applicant on the pre-term cancellation of other contract for the use of fish-breeding site due to the violation of essential conditions of such contract for the last 2 years; (e) there is lack of evidence against the applicant, as ascertained by the Federal Fishery Agency, of non-fulfilment of the activity related to contractual arrangements for management of fish-breeding site (if such agreement had been concluded); (f) the applicant for four consecutive years, including the year of filing the application, performed aquaculture related to conservation of aquatic biological resources with subsequent release thereof to a fishery waterbody; and (g) the applicant's right of ownership or right of operational management for four consecutive years, including the year of filing of the application, property complex, including buildings and (or) constructions and (or) structures that are objects of the capital construction, and equipment and (or) installations designed for performance of aquaculture (fishfarming).
