Abstract This Law regulates the obligations of physical and legal persons who manufacture or place on the market chemical substances or mixtures, bans and restrictions on production, placing on the market, import, export and use of hazardous chemicals or mixtures, classification conditions, labelling and packaging of chemicals and mixtures, creation and maintenance of a register of chemical products, reporting procedure for chemical products, procedure for authorization of hazardous chemical products, reporting responsibilities, control and other aspects related to chemicals and mixtures. The provisions of this Law apply to microorganisms and to viruses, such as active substances in plant protection products and biocidal products. The purpose of this Law is to protect human life and health, the environment and property from the harmful effects of chemicals and mixtures. The provisions of this law apply to manufacturers, importers, exporters, traders and users of chemicals and mixtures. This Law is based on the following principles: (a) precautionary principle in the management of hazardous chemical substances and mixtures, aimed at preventing harmful effects on human health, environment and property; (b) the principle of transparency to ensure that consumers have access to information about the adverse effects that hazardous chemicals can generate substances and mixtures; (c) the safety principle of operations for the management of hazardous chemical substances and mixtures; and (d) green chemistry, also called “sustainable chemistry”, aimed at stimulating the design of products and processes, which lead to a reduction or cessation of use and formation of hazardous substances. Manufacturers and importers of chemical substances and mixtures are required to: (a) identify and evaluate the hazardous properties of the supplied chemical products and the possible risks associated with them to humans and the environment; (b) access to information about identification, hazardous properties of the chemical products they supply and the possible risks associated with them; (c) provision of users and others performing manipulation of a chemical product, with information on the results of the assessment and other accessible and relevant information on the hazardous properties of a chemical product, associated risks and security measures; and (d) keeping up to date the available information on chemical products. This Law consists of XV Sections divided into 47 Articles. Section I lays down general provisions. Section II establishes competences and powers of the central executive body. Section III establishes main responsibilities and liability of the operators of supply chain. Section IV regards prohibitions and restrictions. Section V regards export and import of hazardous chemical substances. Section VI establishes principles of good laboratory practice. Section VII regards registration and authorization. Section VIII regards authorization for trade, distribution and other types of transfer of hazardous chemical substances. Section IX regards reporting on chemical substances. Section X regards storage and retail trade of chemicals. Section XI regards programs and action plans of sustainable management of chemicals. Section XII regards confidentiality. Section XIII regards state control and supervision. Section XIV establishes liability for the infringement of the legislation on chemicals. Section XV establishes transitional and final provisions.
