Abstract

This Government Decree implements Council Regulation (EEC) No. 315/93 laying down Community procedures for contaminants in food and Commission Regulation (EC) No. 1881/2006 setting maximum levels for certain contaminants in foodstuffs. It establishes the pollutants that are contained or may be contained in foodstuffs, the maximum levels of some pollutants in foodstuffs and is aimed at protecting public health. This Regulation does not apply to: (a) pollutants that are important only for the quality of food, but are not significant for public health; alien substances, such as fragments of insects, animal hair and others; (b) microbial toxins, such as botulinum toxin and staphylococcal enterotoxin, as well as microorganisms; (c) auxiliary technological substances; and (d) other pollutants that are subject to specific regulatory acts. Foodstuffs on the market should not contain pollutants in quantities exceeding the maximum levels set forth by this Regulations. The maximum levels specified in the Annex to this Regulation, apply to the edible part of the corresponding food product. If the maximum levels set forth in this Regulation are applicable to dried, diluted, processed or composite foodstuffs consisting of several ingredients, the following is taken into account: (a) change in pollutant concentration as a result of drying processes or dilution; (b) change in pollutant concentration as a result of processing; (c) the relative ratio of ingredients in the product; and (d) analytical limit of detection.
