Abstract

The purpose of the regulation is to avoid harmful effects on the soil, surface and groundwater as well as on human, plants and animals health through proper use of certain wastewater, treated sludges, including sewage sludge compost. The Decree regulates wastewater, sludge and treated sludge, including sewage sludge composted into the wastewater treatment plant, including collected and treated municipal waste for agricultural use. Only compost, sewage sludge and related compost complying with this Regulation may be used in the agricultural field. The agricultural use of sewage, sewage sludge and sewage sludge compost is a licensed activity authorized by the county seat of the county government office acting under the authority of soil protection. The use of sewage sludge compost in agriculture shall be authorized by the soil protection authority if its quality complies with the requirements of this Regulation, and 23/2003 on the technical requirements for bio-waste management and composting shall be complied with during composting. (XII. 29.) KvVM Decree. The permission of the Soil Protection Authority pursuant to paragraph (4), based on the simplified soil protection plan specified in the separate legislation, determines primarily the amount of sewage sludge compostable to the unit of land. The agricultural use of sewage, sewage sludge and sewage sludge compost on a given agricultural area may be authorized for a maximum period of five years. In its decision, the Soil Protection Authority shall authorize the use of sewage, sewage sludge or sewage sludge compost only in the area intended for use with the consent of the land user and at the same time prescribe the conditions thereof. If the land user and the owner are not the same, then the landowner's consent is required. The land protection authority shall also communicate the decision on the permit for the agricultural use of sewage, sewage sludge and sewage sludge to the notary.
