Abstract

These Regulations provide for the harvesting, production, and marketing, and in small part for the importation, of live bivalve molluscs and other shellfish such as echinoderms, tunicates and marine gastropods. They also provide for the purification of live bivalve molluscs. They implement Council Directive 91/492/EC. Regulations 3 to 6 provide for the designation of areas as "designated bivalve production areas" or as areas unsuitable for production and harvesting of live bivalve molluscs. Regulation 6 prohibits the production and harvesting of live bivalve molluscs unless they are from a designated bivalve production area. Regulations 7 to 10 concern the approval and operation of dispatch and purification centres for live bivalve molluscs. These are establishments with tanks in which the molluscs are placed to remove microbiological contamination. Regulation 11 requires that live bivalve molluscs for immediate consumption should be placed on the market only where specified requirements are satisfied. These Requirements can be found in the Schedules to these Regulations. Regulation 12 provides for an exemption from regulation 11 where a coastal fishermen places a small quantity of products on the market. Other provisions deal with monitoring, import of products into the United Kingdom (mainly provided for elsewhere), enforcement, and prescribe offences and penalties. (22 regulations and 9 Schedules)
