Abstract

This Act provides for policies and measures to reduce potential adverse effects of strategic plans, programs, etc. which may have an impact on the environment. An environmental clearance (arts. 18 to 31), which sets out terms for any project, is required in order for the Secretariat to issue a development consent. Functions and Powers of the National Environment Commission, the Secretariat and the Competent Authority are described in detail in Chapter V. The Secretariat shall notify the competent authority and may set a time limit for taking remedial measures in case of non-compliance with the terms of the environmental clearance. Officers of the Secretariat may inspect and control the site of a project in order to ensure compliance with the terms of the environmental clearance. The remaining part of the Act contains penal provisions and provisions of miscellaneous nature.
