Occupiers are defined as persons who are either in physical possession of land, premises or property or are responsible for, and have control over the activities conducted on and the persons allowed to enter or use land premises or property (sect. 1). It also provides for the appointment of inspectors, specifying their powers in section 3. In particular, inspectors may serve notices directing occupiers to control certain weeds (sect. 4). The Lieutenant Governor in Council may make regulations on noxious weed control (sect. 5). Weed control committees may be created at the local level by the council of a municipality to advise on and assist in the organization and administration of weed control programs (sect. 9). The remainder of the Act determines jurisdiction over highways and Crown land, exemptions (waste lands for example), offences and regulatory powers. Regulations on methods of noxious weed control must not be made unless the Environment and Land Use Committee, established under the Environment and Land Use Act, approves the methods (sect. 16).
