It places the Scottish Ministers under a duty to make an assessment of the conservation status of salmon in the areas within the district and provides that the Scottish Ministers may agree a conservation plan with the River Tweed Commission. The Order prohibits the retention of Atlantic salmon in coastal waters. Failure to comply with that prohibition is an offence pursuant to the Scotland Act 1998 (River Tweed) Order 2006. Any person found guilty of such an offence is liable, on summary conviction, to a fine not exceeding level 4 on the standard scale.
