Résumé

This Regional Act lays down provisions to protect wildlife (mammals and birds) existing in the Campania Region and to regulate hunting, which is allowed only when it does not prejudice wildlife conservation as well as the agricultural production. The Region, in compliance with Directives 79/409/EEC, 85/411/EEC and 91/244/EEC, creates protecting zones throughout the migration routes intended for birds. Such zones aim at conserving habitats, protecting the migration transit and restoring deteriorated ecosystems. The capture and killing of birds and wild mammals as well as the collection of eggs and nests are prohibited (art. 3), unless a special authorization has been granted by the Regional Council (by Presidential Decree) to scientific institutes and natural history museums for research and scientific purposes (art. 4, par. 2). The Regional Council, upon advice given by the National Institute for Wildlife, shall authorize the creation of Recovery Centres for Wildlife (in accordance with article 4, paragraph 6 of Act No. 157 of 1992), intended for the rehabilitation of injured wildlife and the reintroduction of wildlife species. The centres must meet the technical and scientific requirements laid down in article 5, paragraph 2. They shall also submit annually to the Regional Council and to the competent provincial administrationa a report concerning all activities that have been carried out. Article 6 concerns the issuance of the provincial authorization to hunt at fixed posts. Article 7 regards farming, keeping and marketing of bred birds belonging to species that may be harvested. Article 8 refers to taxidermy: keeping, marketing and preparation of birds and mammals pertaining to protected species listed out in Act No. 157 of 1992 and treated through taxidermic techniques and other similar processes are prohibited. Administrative functions in matter of hunting shall be entrusted to the provincial administrations, as provided for in article 9. Within six months from the entry into force of this Act, the following special committees shall be established: (a) Technical Committee for Fauna and Hunting; (b) Provincial Technical Committee for Fauna and Hunting. The Committees shall contribute to the elaboration of the Fauna and Hunting Plans referred to in article 11. Such plans shall provide for the establishment of: (a) protection oasis (art. 12); (b) repopulation and capture zones; (c) public centres for wildlife farming; (d) private centres for game production. Article 13, on the other hand, makes provision on public centres for game production. Article 16 specifies the wildlife species that may be hunted and sets out the related hunting periods. However, in case of risk of thinning out of the density of such species under certain climate and environmental conditions, or in case of spread of diseases, the Regional Council may prohibit hunting. Wildlife species originating in third countries can be introduced into the Campania territory only previous issuance of a special authorization by the Ministry of Agricultural Policies (art. 18). Articles 19-21 regulate hunting conditions, taking into particular regard authorized gear and methods. Hunting is forbidden on cultivated lands, gardens, nurseries, flower cultures, cereal and fodder cultures, etc. Article 27 concerns hunters' associations. Inspections shall be carried out by the Provinces (art. 28-30). In case of contravention, they shall apply the penalties established under articles 31-34. Article 39 regards regional hunting licence fees.
