Résumé

This Regional Act lays down rules in matter of gathering and placing on the market of spontaneous fresh and conserved mushrooms, in compliance with the principles established by Act No. 352 of 1993. The Act is divided into five Titles : (I) Aims; (II) Mushrooms gathering; (III) Mushrooms marketing; (IV) Surveillance and penalties; (V) Final provisions. Gathering of mushrooms is subject to the issuance of an authorization (valid on the whole regional territory) and a permit (valid only on the territory of competence of the entity that is in charge of the issuance of the permit itself). The authorization shall be granted by the Mountain Communities, when competent, and by the competent Provinces (art. 2, par. 2). The Regional Council shall determine the days during which gathering is permitted (art. 2, par.6). Holders of lands where mushrooms exist are exempted from the issuance of the authorization and permit (art. 2, par. 8). Article 3 establishes the maximum quantity of mushrooms that may be gathered, which is up to 2 kg per day and only 1 kg per day for the species listed out in article 3, paragraph 1. Gathering of non edible mushrooms may take place only for educational and scientific purposes. Article 4 concerns gathering modalities, specifying the gear that is prohibited. Article 5 lists out the areas where mushrooms collecting is forbidden, such as nature reserves, areas falling within national parks or regional parks, areas of particular scientific interest, etc. Article 8 regulates the issuance of a special authorization intended for research, educational or scientific purposes. Mushrooms may be placed on the market only upon previous assessment of health conditions by the competent local heath authorities (art. 11, par. 4). Inspections shall be carried out by the State Forestry Body. In accordance with article 14, Micologic Inspectorates shall be established under the local health authorities not later than one year from the date of publication of this Act.
