All herbaceous species, shrubs, moss and lichens are considered protected plant species typical of the alpine environment (art. 2). The gathering as well as the keeping of the species (and their parts) listed out in article 3 is forbidden. Article 4 establishes the maximum quantity per day (and per person) of lichens, fresh moss and spontaneous flora species other than those defined by article 3 that may be gathered. However, uprooting of such flora as well as taking of their roots and tubers is prohibited (art. 4, par. 2). The Forestry Inspectorate may authorize the gathering of protected plants (and their parts) for scientific, educational, pharmaceutical and officinal purposes. Nonetheless, the marketing of protected spontaneous species is absolutely prohibited (art. 6). Articles 8 and 9 regulate inspections to be carried out and related penalties respectively.
