Résumé

The Act provides for the integrated pest management in Bhutan, restricting the usage of pesticides as second-line measures against pests and diseases. The definition of pesticide applies to any substance or mix which can prevent, destroy or limit any pest, including defoliant, growth-regulating agents, and post-harvest treatments. The Act ratifies the institution of a Pesticides Board, which shall seat experts in the field of Environment, Forestry, Plant pathology and Entomology, Health, Plant Quarantine, Animal Husbandry and other related fields. The Board shall authorize the importation, manufacturing and sale of pesticides on the basis of scientific and technical evidence supporting their use and on the number already licensed for use in Bhutan. The authorization, covering five years and eventually renewable, could be revoked if the inefficacy or toxicity of the pesticide involved has been proved. A Maximum residue limit is set for food, agricultural commodities and animal feeds. No pesticides shall be used if potentially dangerous for the environment or the health of both people and animals. Inspection and confiscation of chemicals used as pesticides but not complying with the Act shall be enacted whenever there is the suspect of a contravention to the Act itself. No authorization for importation, sale or use is applicable to pesticides that are exclusively destined to household treatments. Wastes deriving from pesticides may be returned where purchased and then disposed of by the Board.
