Order No. 85/2018 regulating the registration provided for in article 17 of Decree-Law No. 121/2017 and the registration of species included in the list of Decree-Law No. 140/99 and Annex III to the Convention on the Conservation of European Wildlife and Natural Habitats (Berne Convention).

This Order enters into force on the day after its publication.
Résumé

The purpose of this Order, consisting of 22 articles and two Annexes, is to ensure that the competent administrative, scientific and nature conservation authorities have the means of monitoring compliance with EU standards, international conventions and national legislation on the protection of species of wild fauna and flora. This Order regulates: a) The conditions for the organization, maintenance and updating of the CITES National Register provided for in article 17 of Decree-Law No. 121/2017 of 20 September; b) The exercise of activities implying the detention of animal species. Without prejudice to the provisions of art. 17 of Decree-Law No. 121/2017 are subject to registration: a) breeders, nurseries, importers, exporters, re-exporters, re-packers, taxidermists, traders, as well as scientific institutions, zoos, botanical gardens, circus promoters, traveling exhibitions, animal exhibitions or similar demonstration hold with species listed in Annexes A, B and C of Council Regulation (EC) No 338/97 of 9 December 1996; b) All persons, whether natural or legal, who hold or carry out activities involving the holding of the following species: native bird or other species of fauna and flora included in the Decree-Law No. 140/99 of April 24, as amended by Decree-Law No. 49/2005 of 24 February and by Decree-Law No. 156-A/2013 of 8 November; Specimens of species included within the scope of the Berne Convention.
