Résumé

This Act lays down rules for the delimitation of the maritime zones of Papua New Guinea, including internal waters, archipelagic waters, territorial sea, coastal waters, continental shelf, contiguous zone and exclusive economic zone in accordance with the United Nations Convention on the Law of the Sea; the jurisdiction of Papua New Guinea in the territorial sea, archipelagic waters, contiguous zone and exclusive economic zone; marine scientific research in the waters of Papua New Guinea and the establishment of the Marine Scientific Research Committee; and the protection of marine environmental protection and the underwater cultural heritage. The baselines from which the breadth of the territorial sea, the contiguous zone, the exclusive economic zone and the continental shelf shall be measured from the low water line in accordance with this Act, the UNCLOS and other rules of international law. The delimitation of the exclusive economic zone and continental shelf between Papua New Guinea and adjacent states shall be effective through an agreement on the basis of international law. Moreover, the delimitation of internal waters in the case of the mouths of rivers or entrances to lagoons, bays, permanent harbor works, gulfs, inlets of the sea, rivulets and streams shall be made by the Head of State through regulations determining closing lines. Pursuant to the UNCLOS, this Act states that the territorial sea of Papua New Guinea shall be the sea between the baselines and a line every point of which is at a distance of 12 nautical miles from the nearest point of the baselines. In addition, subject to UNCLOS, ships of all States shall enjoy the right of innocent passage through the territorial seas of Papua New Guinea. Hereafter, this Act sets forth the criminal and civil jurisdiction of Papua New Guinea in relation to foreign vessels and specifies the conditions to make an arrest or conduct an investigation in Sections 15 and 16. The laws of Papua New Guinea in relation to the safety of navigation and the regulation of maritime traffic; conservation of marine living resources and marine environment; fishery management and conservation; pollution control; customs control; health; sanitary and phytosanitary shall apply to vessels passing through the territorial sea. Papua New Guinea has sovereign rights in the exclusive economic zone to explore, exploit, conserve and manage the natural resources and has jurisdiction in the exclusive economic zone in respect of the establishment and use of artificial islands, installations and structures; marine scientific research; and the protection of the marine environment. In order to conserve marine living resources and marine environment, an area of the waters of Papua New Guinea, including the seabed or any land associated with the waters of Papua New Guinea or any wetland may be designated as a Marine Protected Area by the Minister responsible for environment and conservation in consultation with the Minister responsible for fisheries. Regulations may be made in the fields of maritime delimitation, protection of the marine environment, the passage of ships carrying hazardous waste, and nuclear and radioactive materials, and prevention of pollution from ships to ensure the effective implementation of the provisions of this Act. Furthermore, this Act lays down offences and penalties for the violation of any provisions of this Act or any regulations made under this Act.
