Résumé

These Regulations, made under sections 6 and 92 of the Marine Resources Act 2005, regulate commercial large pelagic longline fishery for tuna, swordfish, marlin and some other species and related activities in the fishery waters of the Cook Islands. The Regulations include the Large Pelagic Longline Fishery Plan (Fishery Plan). The large pelagic longline fishery is hereby declared to be a designated fishery pursuant to section 6 of the Act. The albacore and bigeye stocks that are part of the large pelagic longline fishery are subject to a quota management system (QMS) in accordance with these Regulations and set out in the fishery plan. All quota in QMS stocks is owned exclusively by the Crown until allocated in accordance with the fishery plan and these Regulations. Quota holders shall be subject to reporting obligations. The QMS is managed by the Secretary of Marine Resources, who may issue directives providing for such matters as are contemplated by or necessary for giving full effect to the provisions of this fishery plan. Vessels of 10 metres or more in length must not be used for commercial large pelagic longline fishing or related activities in the fishery waters except in accordance with a valid license issued under the Act and in accordance with the Marine Resources (Licensing) Regulations 2012. Transhipment must be conducted in accordance with the Act. The Regulations specify, among other things, catch documentation sheets and unloading forms. The Regulations also concern discarded catches and require that the Cook Islands National Plan of Action for Reducing Incidental Catch of Seabirds and The Cook Islands National Plan of Action for Sea Turtle By-catch Mitigation must be complied with at all times.
