This Act enters into force on the day the Minister may appoint by notice.
Résumé

This Act makes several amendments to strengthen the Fisheries Laws to deter and eliminate IUU fishing activities in compliance with international, regional and sub-regional standards and management and conservation principles. In Section 2 of the Principal Act, the definitions of domestic-based fishing, fishery waters, foreign fishing vessels, local fishing vessels, and international conservation and management measures are updated and moreover the definitions of illegal fishing, unreported fishing and unregulated fishing are inserted. New Section 9A is inserted regarding the application of international conservation and management measures in the internal waters, archipelagic waters and territorial sea of Tuvalu. New Section 12A is inserted regarding the ownership of data and information provided by the vessel owners. This Act amends 3rd Paragraph of Section 13, as “a valid and applicable permit shall be required for any Tuvalu fishing vessel fishing in the fishery waters, within areas under the national jurisdiction of other State, on the high seas or in an area designated by a fisheries management agreement”. The conditions for the refusal of granting a fishing permit and the suspension and cancellation of fishing permit by the Fisheries Officer are added to Section 18. New Section 21A is inserted regarding electronic monitoring of fishing vessels operating in the fishery waters of Tuvalu. Section 44 is amended by inserting new Sections concerning the designation of ports to which fishing vessels may seek entry; the conditions for the prohibition, refusal or conditional permit for the entry of fishing vessels to a port; offences and penalties; communication of information about the vessel to the flag state of the vessel or to any regional management organization to which the flag state is a member; permitting the entry of vessels to ports in case of force majeure or distress; and the regulations made by the Minister regarding ports, inspectors and related matters. Moreover, new sections are inserted to Section 71 regarding the procedures of citations and prohibited activities. New Section 80A is inserted to lay down penalties for falsifying or concealing markings or altering the registration details of a Tuvalu fishing vessel or of a foreign fishing vessel while in the Tuvalu fishery waters. Finally, the amounts of administrative fines are updated in several sections.
