Résumé

This Law establishes the suppliers and buyers of agricultural and food products, prohibits unfair trading practices in agricultural and food products of supply chain and defines a list of actions and ban on such unfair trading practices, determines the functions and the rights of the relevant institution, the right of initiative for infringement proceedings, reporting to start infringement investigation, the procedure for investigation of infringements, the handling of cases and liability for violations of this Law. This Law applies to: (a) unfair trading practices, where agricultural and food products are sold by suppliers whose annual turnover in the previous financial year between EUR 1 million and EUR 350 million per year, and where agricultural and food products are purchased by purchasers, regardless of their annual turnover during the previous financial year; (b) unfair trading practices, where agricultural and food products are sold by suppliers whose annual turnover in the previous financial year is not exceeding EUR 2 million, purchasers of agricultural products and foodstuffs whose annual turnover during the preceding financial year is more than EUR 2 million; (c) suppliers with an annual turnover in the preceding financial year of more than EUR 2 million but not more than EUR 1 million for purchasers of agricultural and food products of which the annual turnover during the preceding financial year is more than EUR 1 million; (c) suppliers whose annual turnover in the preceding financial year exceeds l EUR 1 million, but not more than EUR 50 million, for purchasers of agricultural and food products whose the annual turnover for the preceding financial year is more than EUR 50 million; (d) suppliers with an annual turnover of more than EUR 50 million but not more than EUR 150 million for purchasers of agricultural and food products with the annual turnover for the preceding financial year is more than EUR 150 million; and (e) suppliers with an annual turnover in the preceding financial year of more than EUR 150 million but not more than EUR 350 million for purchasers of agricultural and food products with the annual turnover for the preceding financial year is more than EUR 350 million. This Act shall apply to the sale of agricultural and food products when supplier of agricultural and food products or a buyer of these products, or both are located in the European Union. It shall not be applicable to supply and purchase contracts of agricultural and food products with consumers and to supply and purchase contracts of food products between agricultural cooperatives and small partnerships and their members. When the contract of sale provides for regular agricultural and food products supply, unfair commercial practices where the buyer is late in paying the supplier: (a) for agricultural and food products, the list of which is approved by the authorized institution of the Republic of Lithuania Law on the Settlement of Agricultural Products, Article 5 (2), and perishable agricultural products and foodstuffs as within 30 calendar days from the delivery of these products specified in the sales contract the end of the period, including the valuation period for these products, or longer than 30 calendar days from the date of that delivery, including the pricing of those products to the date on which the due amount is determined, whichever is the later; (b) for agricultural and food products not classified in item (a) of this paragraph for products: (1) where the contract of sale is concluded between a supplier and a purchaser who is in the public domain longer than established by Article 6 (2) and (2) of the Law on the Settlement of Agricultural Products, considering the time limits set out in paragraph 3; and (3) where the contract of sale is concluded between a supplier and a buyer other than those referred to in this item - within 60 calendar days from the date specified in the contract of sale by the end of the delivery period for those products, including the pricing period for those products, or no later than 60 calendar days after the end of that delivery period, by the date of determination of the amount payable.
