Résumé

This Law transposes the Regulations (EC) of the European Parliament and Council No. 517/2014 of April 16, 2014 on fluorinated greenhouse gases. This law establishes the legal basis for the implementation of measures relating to both climate change mitigation and environmental protection by reducing fluorinated greenhouse gas emissions. The scope of this Law is to regulate at the national level precautionary measures regarding: (a) prevention of leakage, use, recovery and disposal of fluorinated greenhouse gases, as well as those associated with the listed supporting measures; (b) placement on the market of individual products and equipment containing fluorinated greenhouse gases or those operating on their basis, with the exception of refrigeration and/or air conditioning equipment that does not currently contain such gases at the moment of import; (c) special use of fluorinated greenhouse gases; and (d) application of quantitative restrictions for placing on the market of hydrofluorocarbons. This Law establishes standards, conditions and restrictions, applicable to the following fluorinated greenhouse gases: (a) hydrofluorocarbons (HFCs), used as refrigerants, cleaning solvents and foaming agents, including those used in fire extinguishers; (b) perfluorocarbons (PFCs) used in semiconductor production, as cleaning solvents and foaming agents; (c) sulfur hexafluoride (SF6), used in high voltage electrical installations and in the production of magnesium. The provisions of this Law apply to refrigeration, air conditioning equipment, other equipment, installations and products, containing or operating on the basis of fluorinated greenhouse gases. In order to implement this law, the following principles shall be complied with: (a) the principle of “green chemistry”, also called the principle of “sustainable chemistry”, by promoting measures that contribute to the reduction or elimination of emissions of fluorinated gases; (b) the principle of extended responsibility of the manufacturer and/or the end consumer - by establishing the obligation to both to eliminate leaks of fluorinated gases and their recovery, recirculation, regeneration or disposal; (c) the principle of pollution prevention; (d) the precautionary principle in decision making; (e) the “polluter pays” principle; (f) the principle of transparency and accessibility; and (g) the principle of motivation to learn. The release of fluorinated gases into the atmospheric air is prohibited, if such emission is not a technical condition for its intended use. Import, export, re-export and transit of each lot of fluorinated gases, specified in Annex 1, as well as products and equipment containing fluorinated greenhouse gases or those operating on their basis are carried out in accordance with a permit issued by the Environment Agency. This Law contains VIII Chapters divided into 39 Articles. Chapter I lays down general provisions. Chapter II establishes powers and obligations. Chapter III regards prevention of leakages. Chapter IV regards placing on the market and regulation of use. Chapter V regards limitation of the quantity of hydrofluorocarbons placed on the market. Chapter VI regards information and reporting. Chapter VII establishes competence in the process of control performance and liability for the infringement of legislation in the field of reducing fluorinated greenhouse gases emissions. Chapter VIII lays down final and transitional provisions.
