Résumé This Law establishes the basic principles of public-private partnership, forms, methods and procedures for its implementation, rights and obligations of public and private partners. Public-private partnership is a long-term agreement concluded between public and private partners for the purpose of implementing a public project, performing work or providing a public service, based on the ability of each partner to appropriately manage resources, risks and income. Relations in the field of public-private partnership are based on the principles of: (a) equality of approach, impartiality and non-discrimination; (b) integrity; (c) transparency; (d) proportionality; (e) balance; (f) competition; (f) freedom of contract; and (g) cooperation. Maximum duration of a public-private partnership contract cannot exceed 50 years, unless special law envisages other. The public-private partnership is terminated: (a) upon expiration of the contract concluded between public and private partners; (b) based on an agreement between public and private partners; and (c) in other cases provided for by law or agreement.
