This Law enters into force six months after the date of its official publication.
Résumé

The scope of this Law is to strengthen legal and institutional fundamentals in the field of state control over business activities. The objectives of this Law are: (a) ensuring a higher level of protection of the environment, life, health and property of persons; (b) supervision of the introduction and circulation of products on the market in order to ensuring their safety; and (c) implementation of a risk analysis system based on risk criteria. Control shall be intended all actions to verify compliance by persons subject to control, with the provisions of legislation, carried out by a body empowered with control functions, or a group of such bodies. The main principles of control are: (a) prevention of violations of the law through the advisory aspect of control; (b) objectivity and impartiality in planning and implementing state control, drawing up documents related to control, prescribing measures and imposing punishment; (c) control based on risk analysis and assessment; (d) presumption of good faith and compliance by the person subject to control with the law; (e) transparency of individual and regulatory acts issued by the supervisory authority; (f) legality and compliance with the powers expressly provided by law by the supervisory authority in such a way as to ensure the correct, orderly and consistent implementation of state control in accordance with the requirements of the law; (g) the proportionality of control and the appropriateness of its initiation - conducting control based on risk assessment only when it is necessary for the control body to carry out its functions and when all other methods of verifying compliance with the law by the person subject to control have been exhausted; (h) proportionality and expediency in relation to the duration and procedure of control - implementation of control in the shortest possible time, depending on the grounds presented by the control body, as well as the correlation of the efforts made and the applied control method with the level of risk; (i) recording of all actions and controls; (j) the right to appeal against any action or act of the inspector and compensation for damage caused; (k) preventing the existence of a property interest of the inspector by excluding direct deductions to the budget of the relevant supervisory authority of the amounts of fines collected; (l) preventing violation and/or suspension of the activities of the inspected person; (m) confidentiality of information about the person being inspected obtained during planning and carrying out control, in particular information that could affect the good reputation of the business entity in carrying out its activities; dissemination of such information is prohibited, except in cases established by law; (n) conscientious performance of control functions (impartial and fair performance of official functions and duties by the inspector, with the goal of establishing a trustworthy relationship between the control body and the person subject to control); and (o) preventing conflicts of interest between the inspector or head of the control body and the person subject to control. Controlling bodies and authorities involved directly or indirectly in the process of preparation and implementation of state control are obliged to apply and comply with the basic principles of safety, namely: (a) risk analysis; (b) proactive influence; (c) transparency; and (d) consumer protection.
