Résumé This Law makes drastic amendments in the Principal Law, with a special emphasis on the prevention, determination and elimination of IUU fishing. The fishing license and permit is obtained, renewed, or cancelled by the Ministry of Agriculture and Forestry for national and foreign fishermen as well as fishing vessels and other vehicles engaged in fishing and fish breeding. Article 4 of the Principal Act is amended regarding the leasing and technical conditions of aquaculture facilities in the marine waters, inland water environments and as terrestrial production systems under the rule and disposition of the state. Moreover, this Act amends the Article 17 of the Principal Act stating that the fishing port facilities are constructed by the Ministry of Transport and Infrastructure in the shores needed for the purpose of carrying out fishing and aquaculture related services such as sheltering, storing, repairing and maintenance of fishing equipment, landing, storing, controlling of and data collection from fishing vessels and the right to benefit from fishing port facilities will be given primarily to commercial fishermen and fish farmers. In addition to that, the right to benefit from fishing port facilities will be given to the fishing cooperatives or the union of cooperatives for a period not more than 10 years. The Ministry of Agriculture and Forestry may issue a regulation for the administration and inspection of the fishing port facilities and for the terms and conditions of commercial, amateur, and recreational fishing activities in the leased areas. In addition to the obligation of fish passages in inland waters such as dams and regulators in Article 22 of the Principal Act, this Act lays down rules for the alternative measures, such as different migratory routes or fish lift, in case the Ministry of Agriculture and Forestry conducts a scientific research in inland waters above 20 meters. Article 25 regarding the restriction of sale, transit or processing of fish products is amended by inserting a new paragraph stating that the export and import of live fish is subject to permit in order to conserve the resources. This Act inserts the Additional Clause 4 stating that the Ministry of Agriculture and Forestry may develop equipment and systems, such as remote sensing system, and strengthen the cooperation with the relevant national and international organizations to collect data, monitor the fishing activities and determine the breaches of law. Furthermore, this Act inserts the Additional Clause 5 regarding the obligations to the landing of the catch to the ports designated by the Ministry of Agriculture and Forestry according to the activities and the size of the fishing vessels, possession of the permit of the Ministry for the transit of fish products, and submission of these documents as required. Additional Clause 6 lays down the restriction of aquaculture activities at sea and in inland waters without the permit of the Ministry and Additional Clause 7 lays down the requirements for the ship owners and operators who are engaged in commercial fishing in the territorial sea and the EEZ of other countries or in high seas.
