Résumé This Law regulates relations regarding licensing of some activities. It shall not be applicable to the issuance of licences related to licensing agreement between natural and legal persons. The Act consists of seven Chapters divided into 52 Articles: (1) general provisions; (2) the state licensing system; (3) types of activity; (4) licensing of import and export; (5) licensing terms and conditions; (6) renewal, cancellation and suspension of licences; and (7) final provisions. Licensing terms and conditions shall be equal for all persons complying with the established requirements. Special licensing terms and conditions shall be established for some activities for the purpose of the protection of environment and human health. Licences shall be valid on all the national territory except for cases envisaged by the national legislation. Licences shall be classified by the subject (national natural and legal persons on one hand and foreigners, stateless persons, foreign legal persons and international organizations on the other), by the amount of activity (general licences issued for unlimited period and once-only licences issued for a limited period, amount and quantity). The following activities shall be subject to compulsory licensing: (a) industry (energy production, oil and gas exploration, extraction, storage and transportation); (b) nuclear energy; (c) turnover of firearms; (d) outer space; (e) agriculture and land use planning; (f) veterinary (animal drugs manufacturing and veterinary certification of animal products); and (g) viticulture and tobacco. The request for issuing licence shall include: (a) application; (b) notarized copy of the Statute; (c) copy of identity card (for natural persons); (d) notarized copy of the state registration of the applicant as individual entrepreneur; (e) notarized copy of the registration at the state tax inspection; (f) a copy of payment order of licensing fee; and (g) documents attesting compliance with the qualification requirements.
