Résumé

This Law defines legal, economic and organizational grounds for the establishment and operation of Energy Efficiency Fund established to support energy efficiency initiatives, the introduction of incentive and support measures for improving energy efficiency of buildings and energy conservation, in particular in the residential sector, taking into account the national energy efficiency plan , reduction of carbon dioxide emissions in order to implement the Paris Agreement, implementation of the acquis communautaire of the European Union and the Treaty establishing the Energy Community, compliance with Ukraine's international obligations in the field of energy efficiency. The Fund is public institution, a legal entity of public law set up by the Cabinet of Ministers. The Fund is constituted to promote the achievement of overall energy saving in final consumption taking into account Ukraine's national targets for energy efficiency, as well as to implement measures aimed at their achievement as determined in national energy efficiency strategy and energy efficiency plans approved by the Cabinet of Ministers of Ukraine. Method of сalculation of energy savings is approved by the Cabinet of Ministers of Ukraine in accordance with the acquis communautaire of the European Union and the Treaty on the Establishment of Energy Community. Supervisory Council shall be set up to oversee operation of the Fund. Procedure for examination and decision-making related to application on partial recovery of costs of energy efficiency measures shall include: (a) performance of the preliminary energy audit and registration of the application and supporting documents; (b) submitting an application by the final beneficiary or his authorized representative to the representative to the Fund; (c) consideration of the application for compliance with the Fund's programs; (d) decision-making on the compliance of the application with the Fund's programs and determining the size of the grant or the rejection of the application; (e) Fund's confirmation to the final beneficiary of the intention to provide partial reimbursement of the cost of the energy efficiency measures indicated in application, provided that they are implemented in accordance with the submitted application and the Fund's program; (f) partial reimbursement of the cost of energy audit, subject to fulfillment of the conditions of the Fund's programs; (g) involvement of the final beneficiary of partner banks in financing energy efficiency measures on demand; (h) implementation of energy efficiency measures in accordance with the application and Fund's programs; (i) verification of implemented energy efficiency measures - installation (confirmation) of the compliance of the undertaken measures with the terms of the application and the Fund's programs; and (j) partial reimbursement of the cost of the undertaken measures related to energy efficiency (grant payment). Final beneficiary of the grant shall be owner (co-owner) of the building.
