The Directive provides for a derogation of all requirements set out in column (2) of the Schedule granted by Member States to applicants who made an application for derogation before the 1st July 1992. These Regulations also set out the procedures to be followed on an application for derogation (reg. 4) and how such application is to be determined (reg. 5).
