This Code enters into force on 1 January 2016.
Résumé

This Code defines the legal, economic and social conditions and guarantees ensuring free enterprise in the Republic of Kazakhstan, regulates social relations arising from the interaction of business entities and the state, including the state regulation and support of entrepreneurship. The adoption by state bodies or regulatory acts establishing the privileged position of individual subjects of entrepreneurship shall be prohibited. Principles of interaction between business entities and the state shall be as follows: (a) legality; (b) free enterprise; (c) equality of business entities; (d) inviolability of property; (e) fair competition; (f) balance of interests of consumers, business entities and the state; (g) transparency of government activities and availability of information; (h) the effectiveness of state regulation of entrepreneurship; (i) mutual responsibility of business entities and the state; (j) support of domestic producers of goods, works, services; (k) inadmissibility of unlawful state interference in the affairs of subjects of entrepreneurship; (l) promotion of social responsibility of entrepreneurship; (m) limited state participation in business activities; and (n) self-regulation. Business entities shall be classified as small, medium and big. Small business entities shall be prohibited to perform the following business activities: (a) storage of grains and cereal at grain collection points; (b) activities related to turnover of radioactive materials; and (c) activities related to firearms and ammunition for civil use. Forms of joint business partnership shall include family farming. A peasant farm is a labor association of persons in which the implementation of individual entrepreneurship is inextricably linked to the use of agricultural land for production of agricultural commodities, as well as the processing and marketing of these products. Peasant farm shall possess equal rights of agricultural production unit. Peasant farm independently determines the direction of its activities, structure and production volumes, grows, processes and trades products, and also solves other issues related to economic and business activities. The subjects of public-private partnership shall be state partner and private partner, as well as other persons involved in the project implementation of public-private partnership. Public-private partnership shall be implemented through contracts, in particular concession, lease and servicing. This Code contains of VII Sections divided into 324 Articles. Section I lays down general provisions. Section II regards interaction of business entities and the state. Section III regards forms and means of state regulation of entrepreneurial activity. Section IV regards economic competition. Section V classifies the main directions and types of state support of private entrepreneurship. Section VI establishes forms and means of the protection of rights of business entities. Section VII establishes liability for the infringement of legislation in the field of entrepreneurial activity, lays down transitional and final provisions.
