Résumé The 30 sections of this Decree are divided into 15 Chapters: Application sphere and definitions (I); Approval (II); Hazard classification (IIII) Marking (IV); Production, importation and sale (V); Storage (VI); Use (VII); Expiry period for sale and use (VIII); Products for the use in hobby horticulture and for pot plants (IX); Advertisement (X); Internal control (XI); Control (XII); Fees (XIII); Offences and enforcement (XIV); Exemptions and appeal (XV); Entry into force (XVI).¦The Decree applies to all plant protection substances and preparations covered by section 2a and 16 respectively of the Act relative to plant protection substances. Section 2 gives a definition of "preparation". Products shall be submitted for approval to by State Agricultural Supervision Agency. Decisions regarding approval shall take into account agronomic suitability of the product, possible health risks, area of use, packing and labelling and instructions for use, size of packing, protection measures, and advantages on existing products (sect. 4). Conditions for packing are outlined in section 5. Potential hazard classification shall be carried out in accordance with principles of Decree No. 996 of 1997 concerning classification, marking, etc. of hazardous chemicals. Producers of plant protection substances shall obtain a licence from the Department of Agriculture and importers and traders shall be approved by STIL (sects. 10 and 11). Other sections of Chapter V make provisions in relation with responsibilities of traders, bookkeeping, and further handling of products. Also use of plant protection substances requires a permission of the agricultural office of the municipality of the user (sect. 17). Control shall be carried out in principal by STIL and the customs offices (sec 24).
