Résumé This Decree, based on the provisions of the Croatian Mining Law, determines the compensation of damage related to the alienation of mineral raw materials caused by action of a natural or legal person who performed mining works without a valid legal basis. Compensation on the basis of alienation of mineral raw materials is a revenue of the state budget. The type and quantities of illegally excavated or obtained mineral raw materials shall be determined by the mining inspector of the State Inspectorate on the basis of the minutes of performed supervision. The market value of mineral raw materials in the Republic of Croatia shall be determined for two different areas (see article 4, paragraph 2). In case of illegal excavation or extraction of mineral raw materials whose market value is not stated in article 4 of this text, the market value shall be determined by a decision of the Commission for Determining Mineral Reserves established in accordance with article 55 of the Mining Act.
