Decree No. 432 implementing Council Directive 95/21/EC concerning the enforcement, in respect of shipping using Community ports and sailing in the waters under the jurisdiction of the Member States, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control), as amended by Directives 98/25/CE, 98/42/CE and 99/97/CE.

Résumé

This Decree has been adopted in implementation of Directive 95/21/EC. Article 2 determines the seagoing vessels and equipment to which the present provisions shall apply. Inspections shall be carried out by inspectors appointed by the Ministry of Transports and Navigation. The latter shall monitor and coordinate inspection at national ports as well as the analysis of data relating to inspections that have been carried out (art. 3). Article 4 lays down inspectors’ duties. The inspection procedure is described by article 5. Access to State ports shall be denied to ships which do not meet the requirements hereby established.
