Résumé

This Decision validates the List of regulated products (regulated cargoes, regulated materials, regulated commodities), subject to quarantine phytosanitary control (supervision) on customs border of the Customs Union and customs territory of the Customs Union (Annex № 1); Regulation on the procedure of quarantine phytosanitary control (supervision) at the customs border of the Customs Union (Annex № 2); and Regulation on the procedure of quarantine phytosanitary control (supervision) on the customs territory of the Customs Union (Annex № 3). List of regulated products (regulated cargoes, regulated materials, regulated commodities), subject to quarantine phytosanitary control (supervision) includes live insects, acarians, nemathelminths, bacteria and phytoplasmas, viruses and viroids used for scientific research purposes, seeds and planting material, vegetables, fruits, tea, textile plants and fibres, and flowers. Regulation on the procedure of quarantine phytosanitary control (supervision) at the customs border of the Customs Union determines the procedure for application of quarantine phytosanitary control (supervision) for: (a) import to customs territory of the Customs Union of regulated products, included in the List of regulated products (regulated cargoes, regulated materials, regulated commodities), subject to quarantine phytosanitary control (supervision) on customs border of the Customs Union and customs territory of the Customs Union, validated by the Commission of the Customs Union according to article 5 of the Agreement; and (b) export from customs territory of the Customs Union of regulated products, in which relation member states the Customs Union have accepted international obligations on realization of quarantine phytosanitary control (supervision). It shall be mandatory for implementation by enforcement authorities of the Parties, their authorized bodies, local governments, legal entities of any organizational-legal form, citizens, including individual entrepreneurs, activity of which is related to manufacturing, procurement, processing, transportation, storage, trade and use of regulated products. Each lot of regulated products imported to customs territory of the Customs Union, included in the List of regulated products, shall be subject to quarantine phytosanitary control (supervision). Quarantine phytosanitary control (supervision) of imported produce and commodities shall be performed with a view of conformity check of imported regulated products to phytosanitary requirements of the Party, on which territory the place of completion of customs registration is located. Imported produce and commodities subject to quarantine phytosanitary inspection shall be accompanied by phytosanitary certificate. Regulation on the procedure of quarantine phytosanitary control (supervision) on the customs territory of the Customs Union determines the procedure for application of quarantine phytosanitary control (supervision) in relation to transported regulated products on customs territory of the Customs Union in cases, when departure and destination place of lot of regulated products are located in the territory of different member states of the Customs Union and transferred lot of regulated products is not placed under a customs procedure of customs transit or under the customs procedure envisaging export of the commodities from customs territory of the Customs Union.
