Résumé

The present Law lays down provisions relating to fisheries in the Land of Berlin. Article 1 establishes that waters together with aquatic animals and plants are parts of the natural environment and as such the living basis of human society. Quality and diversity of waters are indispensable conditions for the development, conservation and use of fish stocks to be replenished in their complete diversity. An orderly fishery must pursue the conservation of a balanced natural environment of waters both in towns and in the countryside being part of the cultural heritage, as well as to promote free time and recreation purposes. The present Law ensures protection, conservation, replenishment and use of the aquatic animals and plants, as well as the protection of single animals with a view to ensure animal protection. The particular purpose of the present Law is to protect fish stocks, conserve fisheries and regulate the exercise of professional and recreational fisheries. The present Law consists of 53 articles divided into 8 Parts as follows: General provisions (I); Fishing rights (II); Fostering districts, fostering plan, fostering cooperatives (III); Protection of fish stocks (IV); Compensation proceedings (V); Fishery authorities and advisory boards (VI); Penalties (VII); Transitional and final provisions (VIII).
