An application under subsection 61[2] is an application for the determination of native title made to the Registrar of the National Native Title Tribunal. They are amended by giving new rules for the exemption of fees for the granting of applications and the inspection of Registers. Regulation 17 which provides for the calculation of fees is replaced by a new regulation. The fee for an application is not payable if the person liable to pay the fee makes an application under section 35 of the Native Title Act for a determination in relation to a future act in the circumstances that a person if a Government part, the person previously made an application under section 35 and a few other circumstances.
